Maryland False Health Claims Act of 2010

This bill will enable the State to recover damages and penalties from individuals who defraud the State by filing false claims against State health plans and programs (e.g., Medicaid). It also mirrors the federal False Claims Act (“FCA”) by including a “qui tam” provision through which private persons, known as “relators” or “whistleblowers,” can file suit and recover a share of any damages or penalties awarded the State.
